DMCA Notice & Takedown Policy

Parallax Sports respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to notices of alleged copyright infringement that comply with applicable law and are properly submitted to our designated DMCA agent.
1. Filing a Takedown Request
If you believe that your copyrighted work has been copied or used on the Parallax Sports platform in a way that constitutes copyright infringement, please submit a written notification to our designated DMCA agent. Under the DMCA, your notification must include substantially the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material, including the specific URL or URLs where the material appears.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
2. Counter-Notification Process
If you believe that material you posted on the Parallax Sports platform was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your counter-notification must include substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside of the United States, the District of Delaware), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.
Upon receipt of a valid counter-notification, we will forward a copy to the party who submitted the original takedown request. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within ten (10) business days of receiving the counter-notification, we may restore the removed material.
3. Repeat Infringers
In accordance with the DMCA and other applicable law, Parallax Sports has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. We encourage you to consult with a legal advisor before submitting a takedown request or counter-notification.
